{"id":168,"date":"2020-12-07T08:55:00","date_gmt":"2020-12-07T07:55:00","guid":{"rendered":"https:\/\/france-cadastre.fr\/site\/?p=168"},"modified":"2024-11-25T10:20:12","modified_gmt":"2024-11-25T09:20:12","slug":"elargissement-du-droit-de-preemption","status":"publish","type":"post","link":"https:\/\/france-cadastre.fr\/site\/elargissement-du-droit-de-preemption\/","title":{"rendered":"ELARGISSEMENT DU DROIT DE PREEMPTION"},"content":{"rendered":"\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"700\" height=\"444\" src=\"https:\/\/france-cadastre.fr\/site\/wp-content\/uploads\/2020\/12\/preemption.jpg\" alt=\"\" class=\"wp-image-169\" srcset=\"https:\/\/france-cadastre.fr\/site\/wp-content\/uploads\/2020\/12\/preemption.jpg 700w, https:\/\/france-cadastre.fr\/site\/wp-content\/uploads\/2020\/12\/preemption-300x190.jpg 300w\" sizes=\"auto, (max-width: 700px) 100vw, 700px\" \/><\/figure>\n\n\n\n<h1 class=\"wp-block-heading\">-1- que dit la loi<\/h1>\n\n\n\n<ul class=\"wp-block-list\"><li>Cette loi provoque \u00e9galement plusieurs changements au niveau du droit de pr\u00e9emption, seules les mesures les plus int\u00e9grantes ont \u00e9t\u00e9 retenues pour votre information.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Tout d\u2019abord, le pouvoir du Pr\u00e9fet est accru&nbsp;: dans le cas o\u00f9 une commune n\u2019attendrait pas le seuil de logement social souhait\u00e9, le pr\u00e9fet pourra&nbsp; pr\u00e9empter tout type d\u2019immeuble malgr\u00e9 l\u2019avis d\u00e9favorable de la commune concern\u00e9e.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Ensuite, les r\u00e8gles d\u2019utilisation de bien pr\u00e9empter seront assouplies&nbsp;: le titulaire du droit de pr\u00e9emption pour donner au bien pr\u00e9empt\u00e9e un usage diff\u00e9rent de celui mentionn\u00e9 dans la d\u00e9cision de la pr\u00e9emption (usage qui n\u00e9anmoins ne pourra \u00eatre l\u2019un de ceux vis\u00e9s \u00e0 l\u2019article L.210-1 du code de l\u2019urbanisme).<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Aussi, les immeubles qui ont \u00e9t\u00e9 achev\u00e9s depuis plus de 4 ans pourront dor\u00e9navant \u00eatre soumis au droit de pr\u00e9emption. Jusqu\u2019\u00e0 pr\u00e9sent, les immeubles achev\u00e9s depuis moins de 10 ans ne pouvaient faire l\u2019objet d\u2019une pr\u00e9emption sasaf si la commune avait instaur\u00e9 un droit de pr\u00e9emption renforc\u00e9. Aujourd\u2019hui tous les immeubles qui sont achev\u00e9s depuis 4 ans peuvent \u00eatre soumis au droit de pr\u00e9emption urbain simple.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Enfin, peut-\u00eatre cit\u00e9 un dernier changement au nveau du droit de pr\u00e9emption&nbsp;: les cessions \u00e0 titre gratuit sont d\u00e9sormais soumises aux droits de pr\u00e9emption (\u00e9tant exclues les cessions \u00e0 titre gratuit effectu\u00e9es entre personnes ayant des liens de parent\u00e9).<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>\u00c9LARGISSEMENT DU DROIT DE PREEMPTION (SAFER) BORD DE MER.<\/strong><ul><li>Qu&rsquo;est-ce que la <strong>SAFER<\/strong> ? &#8211; Soci\u00e9t\u00e9 d&rsquo;am\u00e9nagement foncier et d&rsquo;\u00e9tablissement rural.<\/li><\/ul><\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>La loi n\u00b02019-469 \u00e9largit le droit de pr\u00e9emption de la SAFER dans les zones littorales, en modifiant la r\u00e9daction de l\u2019article L143-1 du Code rural et de la p\u00eache maritime.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Parmi les zones dites \u00e0 vocation agricole, les b\u00e2timents qui ont fait l\u2019objet d\u2019un usage agricole au cours des 5 ann\u00e9es pr\u00e9c\u00e9dant leur ali\u00e9nation peuvent-\u00eatre pr\u00e9empt\u00e9s par la SAFER pour \u00ab leur redonner un usage agricole \u00bb.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>D\u00e9sormais, dans les communes du littorales, les b\u00e2timents qui ont servi \u00e0 un usage agricole au cours de ces 20 ann\u00e9es pr\u00e9c\u00e9dant leur ali\u00e9nation pourront-\u00eatre pr\u00e9empt\u00e9s par la SAFER pour \u00ab leur remettre un usage agricole \u00bb.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Dans les m\u00eames communes, les b\u00e2timents qui ont \u00e9t\u00e9 utilis\u00e9s pour la production de cultures marines exigeant la proximit\u00e9 imm\u00e9diate de l\u2019eau au cours des 20 ann\u00e9es pr\u00e9c\u00e9dant leur ali\u00e9nation, pourront faire le droit d\u2019\u00eatre pr\u00e9empt\u00e9s par la SAFER pour les consacrer \u00e0 \u00ab l\u2019exploitation de culture marine \u00bb.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Dans tous les cas, la SAFER ne peuvent pas faire de contre-proposition de prix en cas de mutation de destination du b\u00e2timent, sauf si le changement a eu lieu au cours des 20 ann\u00e9es pr\u00e9c\u00e9dant l\u2019ali\u00e9nation en m\u00e9connaissance des r\u00e8gles d\u2019urbanisme.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>En cas d\u2019ali\u00e9nation d\u2019un immeuble non b\u00e2ti \u00e0 vocation agricole et d\u2019un b\u00e2timent \u00e0 usage agricole, la SAFER ne peut exercer son droit de pr\u00e9emption que sur une partie des biens ali\u00e9n\u00e9s.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Rappel&nbsp;: l\u2019article L-142-4 du code de l\u2019urbanisme encourage les collectivit\u00e9s locales \u00e0 \u00e9laborer un SCOT, en r\u00e9duisant leur possibilit\u00e9 d\u2019urbanisation nouvelle pour celles qui ne sont pas couvertes par ce document.<\/li><\/ul>\n","protected":false},"excerpt":{"rendered":"<p>-1- que dit la loi Cette loi provoque \u00e9galement plusieurs changements au niveau du droit de pr\u00e9emption, seules les mesures les plus int\u00e9grantes ont \u00e9t\u00e9 retenues pour votre information.
