Afin que l\u2019int\u00e9gration des diff\u00e9rents documents soit plus rapidement effective, il est pr\u00e9vu que d\u00e9lai pour la mise en conformit\u00e9 du PLU et le SCOT soit d\u2019un an et si celle-ci n\u00e9cessite une \u00e9volution mineure, dans le cas contraire elle sera de trois si une r\u00e9vision est n\u00e9cessaire. Le projet de la loi cr\u00e9e deux nouvelles dispositions pour le SCOT.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>L\u2019analyse du potentiel de densification et de transformation de l\u2019ensemble des espaces b\u00e2tis, pour limiter la consommation des espaces naturels, agricole, forestiers et favoriser la densification en tenant compte des formes urbaines et architecturales.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Un diagnostic agricole du territoire, qui compl\u00e8te le diagnostic \u00e9conomique et prend sp\u00e9cifiquement en compte l\u2019impact de l\u2019activit\u00e9 agricole sur l\u2019ensemble de l\u2019\u00e9conomie du territoire dans un court terme, dans le but de mieux pr\u00e9server, les exploitations agricoles et leurs modes de fonctionnement.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Le r\u00f4le majeur du SCOT comme document pivot de l\u2019am\u00e9nagement commercial est confort\u00e9. Le DAC (document d\u2019am\u00e9nagement commercial), est supprim\u00e9 et remplac\u00e9 au b\u00e9n\u00e9fice du document d\u2019orientation et d\u2019objectifs de revitalisation des centre-ville, de maintien d\u2019une offre commerciale diversifi\u00e9e de proximit\u00e9, pouvant ainsi r\u00e9pondre aux attentes de la population en limitant les obligations de d\u00e9placement et les \u00e9missions de gaz \u00e0 effet de serre. Dans ces conditions d\u2019implantation devront privil\u00e9gier la consommation \u00e9conome de l\u2019espace, dans les entr\u00e9es de ville, par la compacit\u00e9 des formes b\u00e2ties, ainsi que l\u2019utilisation des surfaces commerciales vacantes et les surfaces d\u00e9di\u00e9es au stationnement (souligne le minist\u00e8re). <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>SUPPRESION DE LA PRIME \u00ab&nbsp;DITE PRIME AU SORTANT&nbsp;\u00bb<\/strong><\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Concernant la loi ALUR qui a cr\u00e9e une PRIME AU SORTANT, en leur permettant aux communes qui se retirent d\u2019un p\u00e9rim\u00e8tre SCOT sans en int\u00e9grer un nouveau de ne pas se voir appliquer le principe de l\u2019urbanisation limit\u00e9e en l\u2019absence de SCOT pendant six ann\u00e9es.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Rappel&nbsp;: l\u2019article L-142-4 du code de l\u2019urbanisme encourage les collectivit\u00e9s locales \u00e0 \u00e9laborer un SCOT, en r\u00e9duisant leur possibilit\u00e9 d\u2019urbanisation nouvelle pour celles qui ne sont pas couvertes par ce document.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Selon le r\u00e8glemement, en l\u2019absence d\u2019un SCOT, les communes de France m\u00e9tropolitaine, hors Corse et Ile de France, ne peuvent pas ouvrir de nouvelles zones \u00e0 l\u2019urbanisation par \u00e9laboration, ou modification, r\u00e9vision de leur PLU et carte communale. Dans tous les cas le Pr\u00e9fet peut accorder des d\u00e9rogations apr\u00e8s avis de la CDPENAF (<strong>C<\/strong>ommission <strong>D<\/strong>\u00e9partementale <strong>P<\/strong>r\u00e9servation <strong>E<\/strong>spaces <strong>N<\/strong>aturels <strong>A<\/strong>gricoles <strong>F<\/strong>orestiers) et l\u2019\u00e9tablissement public en charge du SCOT, lorsqu\u2019un sch\u00e9ma et en cours d\u2019\u00e9laboration.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Donc la loi ALUR a permis \u00e0 une commune ou EPCI (<strong>E<\/strong>tablissement <strong>P<\/strong>ublic <strong>C<\/strong>oop\u00e9ration <strong>I<\/strong>ntercommunale) qui se retire d\u2019un \u00e9tablissement public SCOT, sans pour autant rejoindre un autre p\u00e9rim\u00e8tre de SCOT, d\u2019\u00eatre dispens\u00e9 pendant six ann\u00e9es de l\u2019application de la r\u00e8gle d\u2019urbanisation limit\u00e9e en l\u2019absence de SCOT. Cette orientation visait initialement \u00e0 ne pas sanctionner des communes et intercommunalit\u00e9s, bouscul\u00e9es par les recompostions territoriales, qui se voyaient prescrire le principe d\u2019urbanisation limit\u00e9e alors qu\u2019elles avaient pr\u00e9c\u00e9demment investi dans un SCOT.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Malheureusement, cette mesure a engendr\u00e9 un v\u00e9ritable effets pervers, qualifi\u00e9 de \u00ab&nbsp;PRIME AU SORTANT&nbsp;\u00bb, incitant certains EPCI \u00e0 quitter un \u00e9tablissement public porteur de SCOT pour s\u2019extraire de dispositions jug\u00e9es trop contraignantes pour leur PLU.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Par contre, la loi ALUR n\u2019a pas modifi\u00e9 la situation des communes ou EPCI qui ont un nouveau SCOT approuv\u00e9 et qui se voient appliquer le principe d\u2019urbanisation limit\u00e9e, car les dispositions du SCOT ne leur sont pas appropri\u00e9s (ZONE BLANCHE).
