Celui-ci a fait l\u2019objet de critiques, en particulier sur son m\u00e9canisme qui \u00e9tait susceptible de freiner la densification et l\u2019\u00e9talement urbain. Ce COS est donc d\u00e9finitivement abandonn\u00e9 au profits d\u2019autres r\u00e8gles, comme l\u2019emprise au sol, la hauteur des constructions ou encore l\u2019implantation de b\u00e2timent par rapport aux limites s\u00e9paratives.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>La modification emm\u00e8ne des potentialit\u00e9s de sur-COS fix\u00e9es par le r\u00e8glement du PLU, pour l\u2019application des surdensit\u00e9s accord\u00e9es notamment aux constructions satisfaisant \u00e0 des crit\u00e8res de performance \u00e9nerg\u00e9tique. La disparition du COS met \u00e9galement fin au dispositif de transfert de COS qui permettait de construire en ZN (Zone Naturelle).<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Ainsi le calcul du versement pour sous-densit\u00e9 est \u00e9galement impact\u00e9 par la suppression du COS. Cependant ce type de dispositif existe toujours (sans se fonder sur le COS), par l\u2019interm\u00e9diaire d\u2019autres r\u00e8gles qui sont (au gabarit, \u00e0 la hauteur, et l\u2019emprise au sol..) que le PLU fixe d\u00e9j\u00e0.<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>Malgr\u00e9 l\u2019entr\u00e9e en vigueur de la loi, le COS n\u2019est plus opposable aux demandes de permis de construire et les d\u00e9clarations pr\u00e9alables, les instructeurs des permis de construire ne doivent plus tenir compte de cette valeur.<\/li><\/ul>\n\n\n\n<h1 class=\"wp-block-heading\">LE COEFFICIENT DU BIOTOPE<\/h1>\n\n\n\n<ul class=\"wp-block-list\"><li>Afin d\u2019\u00e9viter que la densit\u00e9 ne se fasse aux d\u00e9pens des espaces naturels en ville, le texte introduit aussi un coefficient de BIOTOPE qui \u00e9tablit le ratio entre la surface favorable \u00e0 la surface d\u2019une parcelle construite ou qui le sera. Dans ce cas le PLU pourra favoriser le maintien ou le renforcement de la biodiversit\u00e9 et la nature en ville en r\u00e9servant, lors d\u2019op\u00e9rations de constructions neuves, r\u00e9nov\u00e9es, r\u00e9habilit\u00e9s, une certaine part de surfaces non imperm\u00e9abilis\u00e9es ou \u00e9co-am\u00e9nageables tels que&nbsp;: (surfaces en pleine terre v\u00e9g\u00e9talis\u00e9es, toitures, terrasses, murs et fa\u00e7ade v\u00e9g\u00e9talis\u00e9s, zone humide \u2026) suivant le dossier de communication du minist\u00e8re du logement sur le projet de loi.<\/li><\/ul>\n\n\n\n<h1 class=\"wp-block-heading\">A NOTER<\/h1>\n\n\n\n<p><strong>Il n\u2019est donc plus possible de prendre en compte un COS dans un PLU.<\/strong><\/p>\n\n\n\n<p><strong>Depuis le 27 mars 2014, le COS est supprim\u00e9, afin d\u00e9velopper la densification du tissu urbain, cette modification a impact\u00e9 les outils de la constructibilit\u00e9&nbsp; et le contr\u00f4le de division des terrains b\u00e2tis.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>SUPPRESSION DU COEFFICIENT D\u2019OCCUPATION DES SOLS Jusqu\u2019\u00e0 aujourd\u2019hui, le PLU (Plan Local Urbanisme) fixait la densit\u00e9 de surface constructible, constitu\u00e9e en majeur partie par le COS (Coefficient d\u2019Occupation des Sols) qui vous indique le nombre de m\u00b2 de surface plancher&hellip;<\/p>\n","protected":false},"author":1,"featured_media":127,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[1],"tags":[],"post_series":[],"class_list":["post-126","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-ressources","entry","has-media"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v24.9 -
